Notice of Alaska Statute 43.23.021. Delayed payment of certain dividends.

Sec. 43.23.021:

(a) Notwithstanding other provisions regarding the payment of permanent fund dividends, if an individual is required to register as a sex offender or child kidnapper under AS 12.63 and has not registered or has not completed the required periodic verifications or notices required under AS 12.63, payment of the dividend for that individual shall be delayed.

(b) If payment of a dividend is delayed, the department shall notify the individual in writing of the delayed payment status, explain the requirements of this section, and request proof of registration and compliance with the verifications and notices required under AS 12.63. The dividend may not be paid unless, within one year after the notification, the department determines that the individual has registered and is in compliance with the verifications and notices required under AS 12.63.


Alaska Statute 11.56.205. Unsworn falsification in the first degree.

Sec. 11.56.205:
  • A person commits the crime of unsworn falsification in the first degree if the person violates AS 11.56.210(a)(1) and the application is an application for a permanent fund dividend.
  • In this section,
    • "application for a permanent fund dividend" includes a written or electronic application and any other documentation submitted to support an application for a permanent fund dividend;
    • "permanent fund dividend" has the meaning given in AS 43.23.295.
  • Unsworn falsification in the first degree is a class C felony.

What type of application will you be filing?

Each individual must file a separate application and sign it.

Emancipated minors: An "emancipated minor" is an individual under the age of 18 who has been declared legally responsible for themselves by the Superior Court of the State. Emancipated minors must file a paper Adult application. A copy of the court documents granting "emancipated minor status" must also be submitted.

Married minors: If you are married and under the age of 18, you must file a paper Adult application. A copy of your marriage certificate must also be submitted.

Sponsors must file a separate Child application for each of their dependent children.

Has the sponsor filed?: A child must have an eligible sponsor's application on file before a dividend payment will be issued. Each child application may have only one sponsor. If you receive an error message during the online application process indicating an application has already been submitted for your child, file a paper application before the March 31st filing deadline.

Child’s first application?: If the child was born to or adopted by the sponsor on or before December 31st an application may be filed during the application period.

You are required to submit one of the following for identification purposes:

  • The child’s original birth certificate or an original true certified copy (photo copies, hospital certificates and heirloom certificates are not accepted) or
  • The child’s original passport or
  • Original Naturalization Papers.

You MUST submit the application by the March 31st deadline even if you do not have access to the required documents. Documents can be provided after the timely application is submitted.

Help

An adult who is authorized by law to sign on behalf of another adult must provide evidence of their legal authority.

Third Party Payees are not automatically authorized to file on behalf of their clients. You may apply for another adult *ONLY* if you meet one of the following requirements:

  • You hold legal Power of Attorney for the adult, or
  • The applicant is a disabled or incompetent adult *AND* you are the legal guardian or conservator.
